GRANT OF LICENSE DoGoodSoft grants you the rights of installing and using the SOFTWARE PRODUCT only on one computer, and reserves the right to take them back at any time. 2. COPYRIGHT All title and copyrights in and to the SOFTWARE PRODUCT and any copies of the SOFTWARE PRODUCT are owned by DoGoodSoft or its suppliers. All title and copyrights in and to the materials accessed by this SOFTWARE PRODUCT belong to their respective owners and are protected by relevant copyright laws and other intellectual property laws and treaties. This LICENSE AGREEMENT does not authorize you to use the contents of such materials. 5. NO GUARANTY FOR DEFECTS You shall be solely responsible for all losses and risks arising out of your use of this SOFTWARE PRODUCT. To the maximum extent allowed by relevant laws, DoGoodSoft and its suppliers are not responsible for any defect guarantees or conditions, whether expressed or implied, including (but not limited to) implied guarantee responsibilities on fitness for a particular purpose and non-infringement. 6. NO LIABILITY OF COMPENSATION FOR CONSEQUENTIAL DAMAGES To the maximum extent permitted by relevant laws, DoGoodSoft or its suppliers are not responsible for special, consequential, direct or indirect damages (including but not limited to loss of operating profits, business interruption, data loss or other tangible or intangible damages/losses) caused by the use of this SOFTWARE PRODUCT. This provision does not differ whether or not you have informed DoGoodSoft or its suppliers about the possibility that such damages may occur. Under any circumstances, the maximum liabilities of DoGoodSoft or its licensees shall be the purchase price of this SOFTWARE PRODUCT. The above disclaimers and statement of limitations shall apply whether you accept the SOFTWARE PRODUCT or not. 7. ABOUT THE MEDIA OF THE SOFTWARE DoGoodSoft guarantees that, under proper use, the media on which this software is contained is free of defects in materials or workmanship within 90 days after this SOFTWARE PRODUCT is delivered. DoGoodSoft's all liabilities, and the only remedy to you, if there are actually defects found and confirmed on the media, is to change the media for this SOFTWARE PRODUCT. This guarantee does not cover media defects caused by accidents, misuses or improper applications. The warranty period of the changed media will be the remaining days of the original warranty period, or thirty days, which is longer. 8. MISCELLANEOUS This LICENSE AGREEMENT is governed by the laws of China (including Hong Kong, Macao and Taiwan). For any possible lawsuits arising out of this LICENSE AGREEMENT, you agree that the Court of First Instance shall be a local court in Luoyang, China.
